Terms of Service
Last updated: [DATE OF PUBLISH]
IN PLAIN ENGLISH, FIRST
- By using Nearest Circle, you're agreeing to use the app to organise and celebrate your own family.
- You own the photos and content you upload.
- You'll only add real family members' information with their (or their parent/guardian's) knowledge.
- You're responsible for keeping your account secure.
- We'll do our best to keep the app running reliably, but like any online service, we can't promise it'll never have an outage or a bug.
Full detail below.
1. Who can use Nearest Circle
You must be 18 or older to create a Nearest Circle account and become a family owner or member. Children's profiles can be added to a family by an adult account holder, but children do not create their own accounts.
2. Your family circle
A Nearest Circle account represents one family group, managed by a family owner, with up to a set number of family member accounts (see current plan limits in the app). The family owner is responsible for who they invite and what family information is added.
You agree to only add real people you have a genuine family relationship with, and to only add a child's profile if you are that child's parent or legal guardian, or have their parent/guardian's permission to do so.
3. Your content
Photos, names, dates, and other content you upload remain yours. By uploading content to Nearest Circle, you give us permission to store, display, and process it solely for the purpose of providing the app's features to your family circle — we do not use your family's content for any other purpose, including advertising.
You're responsible for making sure you have the right to upload any photo or piece of content you add.
4. Free and Premium features
Nearest Circle currently offers a Free tier and Premium features. [Premium billing not yet live — this section will be updated with pricing, billing terms, refund policy, and cancellation process once available.]
5. Acceptable use
Please don't use Nearest Circle to upload content that's illegal, harmful, or that you don't have the right to share; add another person's family information without appropriate permission; attempt to disrupt, hack, or reverse-engineer the app; or use the app for any purpose other than organising and celebrating your own family. We may suspend or close accounts that violate these terms.
6. Google Calendar connection
If you connect Google Calendar, you're also subject to Google's own Terms of Service. We only read your calendar data to display it in Nearest Circle; we never modify your actual Google Calendar.
7. No warranty
Nearest Circle is provided "as is." While we work hard to keep it reliable and to protect your family's memories and information, we can't guarantee the app will always be available, error-free, or uninterrupted. We recommend keeping your own backup copies of especially precious photos and memories, as with any digital service.
8. Limitation of liability
To the fullest extent permitted by law, Nearest Circle and its operator are not liable for indirect or consequential losses arising from your use of the app. Nothing in these terms limits liability for things the law doesn't allow us to limit, such as death or personal injury caused by negligence, or fraud.
9. Ending your account
You can close your account at any time from Settings. See our Privacy Policy for what happens to your data when you do. We may also suspend or close an account that violates these terms, with notice where reasonably possible.
10. Changes to these terms
We may update these terms from time to time. We'll update the date at the top, and let you know directly for any significant changes.
11. Governing law
These terms are governed by the laws of England and Wales.
